Terms and Conditions of Membership & App Use

1. Membership & Joining

  • By completing the registration via the ClubRight app/portal, you are entering into a legally binding contract with [Your Gym Name].

  • Membership is personal to you and is non-transferable.

2. Access Codes & Anti-Tailgating Rule

  • Unique PIN: Upon joining, you will be issued a unique access PIN via the ClubRight app. This PIN is for your exclusive use only.

  • Strict No-Sharing Policy: You must not share your PIN or allow any other person to use it to access the facilities.

  • Tailgating: Allowing non-members to enter the gym behind you ("tailgating") is strictly prohibited.

  • Penalties: Our Glasgow premises are monitored by 24/7 CCTV linked to our entry logs. If you are found to have shared your PIN or facilitated tailgating:

    1. Your membership will be terminated immediately with no refund.

    2. We reserve the right to charge a £[e.g., 30.00] penalty fee to your stored payment method to cover the guest's unauthorised use.

3. Class Booking & "3-Strike" No-Show Policy

To ensure all members have a fair chance to attend classes, we operate the following policy:

  • Cancellations: If you cannot attend a booked class, you must cancel via the ClubRight app at least [e.g., 2 hours] before the start time.

  • The Strike System: A "Strike" is recorded against your account if you fail to attend a booked class without cancelling ("No-Show").

  • Three Strikes: If you accrue 3 strikes within a 30-day period, your booking privileges will be suspended for [e.g., 7 days].

  • Strikes will reset automatically after [e.g., 30 days] from the date of the first strike.

4. Payments & Fees

  • Collections: Monthly payments are processed via [GoCardless/Stripe].

  • Arrears: If a payment fails, your PIN code will be automatically deactivated by ClubRight until the balance is settled.

  • Notice: We provide 30 days' notice for any price adjustments via the app or email.

5. Cancellations & Refunds

  • Cooling-off: You have 14 days from joining to cancel for a full refund, provided the facilities have not been used.

  • Standard Notice: To cancel a rolling membership, you must provide [e.g., one full calendar month] notice via the ClubRight app "Cancel Request" feature or by emailing [Your Email].

6. Health & Safety

  • PAR-Q: You must complete the health questionnaire on the app accurately. You are responsible for updating us on any changes to your health.

  • CCTV: For the safety of members and staff, 24-hour CCTV is in operation. Footages are reviewed daily to monitor PIN usage and gym safety.

7. Liability

  • Elite  Evolution  is not liable for loss or damage to personal property.

  • Members use the facilities at their own risk, except in cases of proven negligence by the gym.

8. Governing Law

  • These terms are governed by Scots Law. Any disputes shall be settled in the Scottish Courts.
